Module description

A distinctive part of this module is our emphasis on practical activities such as client interviewing, negotiation and advocacy. In one term, we focus on persuasion (negotiation and advocacy). In the other term, we focus on problem-solving (interviewing and counselling). Students who like activities such as mooting, client interviewing and Street Law often choose this module because of its practical focus. Students also learn how to use 'positional' and 'principled' methods of negotiating a resolution to a legal dispute. You would learn how to construct and present a 'theory of the case' in advocacy. Students learn how to use a 'client-centred interviewing' approach based on the model developed by Binder, Bergman, Tremblay and Weinstein in the United States.

 As well as providing opportunities to enhance your practical skills, this module provides opportunities for discussion. We integrate the development of lawyers' skills with investigation of theory and ethics about lawyers' work. For example, students learn how to resolve ethical dilemmas that lawyers face using the 'zealous advocate', 'responsible lawyer', 'moral activist' and 'ethics of care' approaches. Students learn to improve their performance by applying your theoretical and ethical knowledge to issues arising from your experience of negotiation, advocacy and interviewing.
