Food Consumer Protection Law

Module description

Food Consumer Protection Law examines the common law and statutory rules designed to protect consumers from unsafe and qualitatively defective goods with particular reference to food. The emphasis is on compensation, as opposed to deterrence or punishment, since food quality is primarily a matter of civil law.

The module covers four topics:

  1. Contractual liability - the varieties of supply of goods contract and the relative importance of contractual undertakings. Conformity with the contract and the implied terms as to description, satisfactory quality and fitness for purpose. Remedies for breach of the implied terms and limitations on the buyer's right to reject goods and, finally, exclusion and limitation of liability
  2. Liability under the tort of negligence - the duty of care, breach of duty, causation and remoteness of harm
  3. Consumer Protection Act 1987 - breach of statutory duty and producer liability under Part I of the 1987 Act. The concept of defectiveness and theoretical underpinnings of the strict liability regime
  4. The criminal law and food quality - food not of the nature, substance and quality demanded by the consumer and sale to the purchaser's prejudice under section 14 of the Food Safety Act 1990 and the available defences

Assessments

  • Assignment 1: 40%
  • Assignment 2: 60%

If the aggregate mark is below 50% and the mark for each component is below 50% the candidate shall be re-assessed by re-submitting the failed assignments or a student may elect to submit new pieces of work.
