Module code: LLMP 5208
The module examines the law relating to the pollution of watercourses. The principal topics are common law liabilities which might arise in respect of water pollution, and the statutory protection of controlled waters. In the former of these topics, the law relating to nuisance, riparian rights and liabilities, strict liability, trespass and negligence is studied. The statutory protection of controlled waters looks at a range of matters, including nitrates, water protection zones, permitting discharges, storage and containment obligations, anti-pollution works notices, the offences of causing or knowingly permitting polluting matter to enter a watercourse, and the Water Framework Directive.
