Module description

The module looks at a neglect area of academic study in relation to the role of employment law within contemporary society. By considering the history and development of legislation in relation to collectives it allows students to question the effectiveness of such provision. It then considers the manner in which the judiciary has interpreted the this legal provision from the development of the so called ‘golden formula’ through the periods of 2 world wars and on to a consideration of the ‘period of the ‘social contract’ With the demise of this period of consensus and a much more ‘active’  stance by the government there is an opportunity to question the available of space within which workers can express their human rights and the desire of employers to protect managerial prerogative. Whilst by its nature the module looks at the relationship between organised employer and employee groups (including Trade Unions) the more recent development of ‘partnership’  and/or ‘workforce’ agreements in non-union settings has led to the development of a differentiated legal regime supporting consultation rather than negotiation. The module therefore looks into the manner in which such arrangement are regulated.

Contact hours per student per year

This is a distance learning module therefore much of the learning is undertaken using the handbook provided in the students own time. Only minimal contact time (plus email/telephone) support is provided. The module handbook contains self-assessment questions to reinforce learning outcomes.
