Module description

The syllabus for this subject covers the following areas of Property Law:

  • What is land to include the distinction between fixtures and chattels
  • The Unregistered Land and registered Land systems
  • Formalities
  • Trusts of land and co-ownership to include joint tenancy and tenancy in common and severance
  • Leaseholds including the essentials requirements for a lease, enforceability for leasehold covenants and remedies for breach of covenant
  • An introduction to Commonhold
  • Easements including the essential ingredients for creation of an easement and method of creation/acquisition
  • Freehold Covenants both positive and restrictive and common Law and equitable rules
  • Mortgages including their creation of a Mortgage and rights of mortgagors and mortgagees
