Module description

The module seeks to provide students with an understanding of The law of Equity and Trusts

In this Module we concentrate upon the management of property within such relationships and, in particular, the management of personal property.

We will consider how trusts are created and look in detail at different types of trusts, such as secret trusts, private trusts and purpose trusts. We will also consider how principles similar to those of the trust can be used within other institutions, such as charities and unincorporated associations. Finally we will look at the administration of trusts, including types of trustee, trustee duties, trustee discretions and the fiduciary nature of the trustee/beneficiary relationship, with particular emphasis on the standard of behaviour required of trustees and the consequences of any breach of a trustee's duties.

Studying this Module will enable students to demonstrate a capacity for analytic and deductive reasoning, together with the ability to apply the law to complex situations, particularly through the mechanism of problem solving.
