Module description

The module seeks to provide students with an understanding of Contract law including:

  • Offer and Acceptance
  • Consideration and Intention to create legal relations
  • Problems associated with the identification of consideration
  • Equitable concept of estoppel
  • Terms of the contract
  • Express and implied terms, in particular The Sale of Goods Acts
  • Categorisation of terms
  • Misrepresentation
  • Identifying misrepresentation
  • Remedies available under the Misrepresentation Act 1967 and the common law.
  • Frustation
  • The practical and theoretical issues concerning frustration and its relationship to restitution
  • Agency
  • The different types of agency and the treatment of commercial agents.
  • Privity of contract
  • Examination of the doctrine and the Contract (Rights of Third Parties) Act 1999
  • Remedies for breach of contract
  • Damages, an outline of the equitable remedies and issues of restitution
